This is an action of the appellant as plaintiff against the appellee as defendant on a complaint for damages for the death of Maurice Lobree, alleged to have been caused by the negligence of the defendant as the result of an automobile accident. At the trial, the plaintiff called two police officers of the City of St. Petersburg. In the course of the preliminary examination of the first officer, he testified:
